These Terms and Conditions ("Terms") govern your access to and use of the Digicare mobile application, website, AI-powered health assistant, and related services (collectively, the "Services").
By accessing or using Digicare, you agree to be legally bound by these Terms of Service. If you do not agree, you must not use the Services.
DIGICARE is a digital health platform that provides access to health-related knowledge through an AI-powered agent, as well as access to licensed and professional health consultants. Digicare is not a hospital, clinic, or medical practice.
Every user must be at least 18 years old, or the legal age of majority in your jurisdiction, to create an account and use Digicare independently. If you are under the required age, you may only use the Services with the consent and supervision of a parent or legal guardian.
When creating an account, you agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Digicare reserves the right to suspend or terminate accounts that provide false information or violate these Terms.
The AI-powered agent on Digicare provides general health information, education, and guidance for informational purposes only. It does not provide medical diagnosis, treatment, prescriptions, or emergency care.
Information provided by the AI should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional regarding any medical condition.
Digicare may enable users to connect with independent healthcare professionals or consultants. These are trained, tested and trusted health care professionals with track record. Any advice, opinions, diagnoses, or services provided by these independent healthcare professionals and consultants shall be based on information available to them. Digicare shall not be held liable where a user withholds critical health, environmental and relevant information from these professionals. Digicare does not guarantee outcomes, accuracy, or suitability of any consultation.
Digicare is in no way or manner designed for emergency medical situations. If you believe you are experiencing a medical emergency, you must immediately contact your local emergency services or visit the nearest medical facility.
By using Digicare, you agree that you shall: - Use the Services only for lawful and personal purposes · Not misuse, abuse, or interfere with the platform · Not attempt to reverse engineer, copy, or exploit any part of the Services · Not provide false or misleading health information intentionally · Respect the privacy, rights, and dignity of consultants and other users. You are solely responsible for the content you submit, including health information, messages, and uploads.
Digicare reserves the right to report any unlawful or illegal use of our platform to the relevant authorities for further investigation and action. All activities on our platform must be within legal limits, confines and reasonable use.
Certain features or consultations on Digicare may require payment. Where applicable: - Fees will be clearly disclosed before payment · Payments are processed through third-party payment providers · Digicare does not store full payment card details.
Refunds, where applicable, are subject to the specific terms disclosed at the point of purchase. The user must be aware that such payment or fees may include Tax or Governmental/Statutory surcharges as required by Laws of the Federal Republic of Nigeria or any other Federal Law as the case may so require.
All content, software, trademarks, logos, designs, and materials provided through Digicare are owned by or licensed to Digicare, unless otherwise stated.
You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. No rights are granted to copy, modify, distribute, or create derivative works without prior written consent.
Your use of Digicare is subject to our Privacy Policy, which explains how we collect, use, and protect personal and health-related data. By using the Services, you consent to the data practices described in the Privacy Policy.
Digicare may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.
We may update these terms periodically; continued use of the Services after updates constitutes acceptance of the revised terms.

The Services are provided on an "as is available" basis. To the fullest extent permitted by extant law, Digicare disclaims all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement.
Digicare does not guarantee that the Services will meet your expectations or health outcomes.
To the maximum extent permitted by law, Digicare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
Digicare's total liability, if any, shall not exceed the amount paid by you to Digicare in the six months preceding the claim.
You agree to indemnify and hold harmless Digicare, its officers, directors, employees, and partners from any claims, damages, losses, or expenses arising from use of the Services, violation of these terms, interaction with consultants or third parties.
Continued use of Digicare after changes take effect constitutes acceptance of the updated policy.
These terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction where Digicare is registered, without regard to conflict of law principles.
Any disputes arising from these terms shall be resolved in good faith through negotiation, mediation and where necessary, through the courts of competent jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
